What we collect, and what we do with it.

1. Who this is about

This policy covers predictivewins.com and any page served from it. The site is operated by Predictive Wins LLC, a Texas limited liability company, trading as Predictive Wins (“we”, “us”, “our”).

It covers information collected through the website only. If you are a client, the handling of information inside a training engagement is governed by the agreement we signed with you, not by this page.

We are a United States business and this site is intended for people in the United States. We do not actively market this site or our services to individuals outside the United States,, and this policy is written to address applicable US law.

2. What we collect

What you give us. We collect information that you choose to provide through forms, downloads and other features on the site, which currently include::

• Ask a question. Your name, your email address, your company if you enter it, and the question you write.
• Partner application. Your name, your email address, your company if you enter it, and what you tell us about what you have sold and who you sold it to.
• The Offering Guide, Race R.E.A.D.Y. checklist and other downloadable materials. Your name and your email address, and any other information identified on the applicable download form, in exchange for the download.
• Blog or other resource downloads. Information you provide when requesting or downloading a resource from the site.
• Scheduling. If you choose to schedule a meeting through Calendly, you may be asked to provide information such as your name, email address, scheduling preferences and information you choose to include with the appointment
• Anything you email us after finding an address here.
• Information you provide when using another interactive feature that we may add to the site.

We do not intend to ask for payment details, government identifiers, sensitive personal information, such as Social Security numbers, financial-account credentials, precise geolocation, health information, biometric information, or other sensitive data anywhere on this site. Please do not send that information to us through a form.

What the Race R.E.A.D.Y. diagnostic does not collect. The Race R.E.A.D.Y. diagnostic currently made available directly through this site runs entirely in your browser. Your answers are not transmitted to us, and we do not know who took it or what they answered. We may receive ordinary technical information associated with your visit to the page, as described below, but not your diagnostic responses. If we later change the diagnostic so that answers or results are transmitted to us, we will update this Policy before using that information in a materially different way.

What we collect automatically. When you visit the site, our hosting provider and other service providers may automatically receive limited technical information associated with your request, such as your IP address, browser and device type, referring page, pages or resources requested, date and time of access, and information used to operate, troubleshoot, protect and secure the site. We use this information principally to deliver the site, maintain security, diagnose problems and understand whether the site is functioning properly.

The site currently uses Webflow for website hosting and form processing and Cloudflare Turnstile to help protect forms against automated abuse. These services may receive technical information about your browser, device and interaction with the site as necessary to provide their services.

The site may also load fonts or other website resources supplied by third-party providers. Depending on how those resources are configured, the provider may receive technical information such as your IP address, browser information and the resource requested.

Google Analytics. We may use Google Analytics to help us understand how visitors use the website. Google Analytics may collect information such as pages viewed, session activity, browser and device information, approximate location, and identifiers stored in cookies or similar technologies. Google Analytics uses IP addresses during collection for purposes such as determining approximate location and operating the service; Google states that raw IP addresses are not associated with user identifiers and are discarded after use rather than logged as part of Google Analytics reporting data. We do not use Google Analytics for cross-context behavioral advertising, remarketing, or targeted advertising, and we do not enable Google Analytics advertising features for those purposes. If we materially change how we use Google Analytics, including by enabling advertising or remarketing features, we will update this Policy and provide any notices or choices required by applicable law.

3. Cookies and similar technologies

The site and the services used to operate it may use cookies, local storage or similar technologies. These technologies may be used to operate website functionality, maintain security, prevent abuse, remember technical settings and provide requested features.

For example, Webflow and Cloudflare Turnstile may use or access technologies necessary to host the site, process forms or distinguish legitimate users from automated traffic.

Some third-party features are activated only when you choose to use them. For example, clicking a scheduling feature may connect your browser to Calendly, and interacting with embedded or linked social-media content may connect your browser to the applicable social-media provider. Those providers may use cookies or similar technologies under their own policies.

If we use analytics cookies that are not necessary to operate the website, we may provide a mechanism for you to make applicable cookie choices before those technologies are used, as required by law.

Your browser can block or delete cookies. Blocking some cookies or technologies may cause forms or other site features not to function properly; these may stop forms from submitting.

4. Why we use what we collect

We use it for those things and for other purposes reasonably compatible with them or disclosed in this Policy and/or to you when information is collected. We do not use information collected through this site to make an automated decision about you that produces legal or similar significant effects.

5. Marketing

Submitting a form does not put you on a mailing list. We do not run automated email sequences, and we do not sign you up to anything you did not ask for. If we ever start a newsletter, it will be something you opt into, not something you are enrolled in. Marketing communications, if we later offer them, will include any opt-out mechanism required by applicable law.

6. Who else sees it

We may disclose personal information to companies and people that help us operate thesite and our business when reasonably necessary for them to perform services for us, including::

• Webflow, who hosts this site and processes website forms on our behalf.
• Cloudflare, which provides Turnstile and related website-security and abuse-prevention services.
• Our email, communications and IT providers, who carry, store or secure the messages we send and receive.
• Scheduling providers such as Calendly, when you choose to use a scheduling feature.
• Website infrastructure, font, hosting, cybersecurity, data-storage and backup providers.
• Social-media or content providers when you choose to interact with content or features supplied by them. Depending on how that content is provided, those platforms may receive technical information from your browser when the content loads or when you choose to interact with it. Their handling of information is governed by their own privacy policies.
• Professional advisers such as lawyers, accountants and consultants.
• Contractors or service providers that need the information to perform services for us.
• Anyone we are legally required to disclose to, if we receive a valid legal demand.
• A buyer, successor or other participant in a merger, acquisition, financing, reorganization, sale of assets or similar business transaction.
• Other persons with your direction or consent.

As of the date of this Policy, we do not sell your personal information, and we have not sold personal information through this site. We do not share it with third parties for cross-context behavioral advertising or process it for targeted advertising. We do not trade or rent contact lists.

7. Where it is stored

We are a United States business and our host is in the United States. We and our service providers may store and process information in the United States and other locations in which they maintain facilities or provide services. If you are writing to us from outside the US, your information may be transferred to and processed in the United States, where privacy laws may differ from those where you live..

8. How long we keep it

• Form submissions: for as long as the conversation is live, and then up to 24 months after our last contact, so we can pick a thread back up.
• Partner applications: up to 24 months from the decision.
• Server logs: as long as our host retains them under their own policy.
• Technical and security information: for as long as reasonably necessary for security, troubleshooting, system administration and the applicable service provider's normal retention practices.
• Scheduling or third-party service information: for the period reasonably necessary for the applicable interaction and thereafter in accordance with our business-record retention practices and the provider's applicable settings.
• Google Analytics user-level and event-level data: up to 14 months.

Ask us to delete something sooner and we will, unless we are required to keep it.

We may keep information longer when reasonably necessary to comply with law, maintain business or tax records, resolve a dispute, establish or defend legal claims, prevent fraud or abuse, enforce an agreement, or maintain the security and integrity of our systems.

If an inquiry develops into a client, partner or other business relationship, information relating to that relationship may be retained under the recordkeeping practices applicable to that relationship rather than the periods above.

9. How we protect it

The site is served over HTTPS. Form submissions sit inside our host’s platform behind authenticated access, and the number of people with that access is small. We also use tools intended to reduce automated abuse and malicious form submissions. No website can promise perfect security, and we are not going to pretend otherwise — and we seek to limit the information we collect and retain to information reasonably needed for the purposes described in this Policy.

10. Your choices and privacy rights

Everyone. You may contact us to ask what personal information we maintain about you, request correction of inaccurate information, or request deletion of information. We will consider and respond to requests consistent with applicable law, our ability to verify the request, and any legal or legitimate reason we have to retain the information.

Depending on where you live and whether a particular privacy law applies to us, you may have additional rights concerning your personal information, which may include rights to access, obtain a copy of, correct or delete personal information and to opt out of certain sales, targeted advertising or profiling. We will not discriminate against you for exercising a privacy right provided by applicable law.

If you are a California resident. If and to the extent the California Consumer Priovacy Act (CCPA) - as amended by the California Privacy Rights Act (CPRA) – applies to Predictive Wins LLC or grants you rights with respect to information we maintain, those rights may include the right to request: the categories and specific pieces of personal information we have collected, where we got it, why we collected it, and who we disclosed it to; deletion of that information; correction of anything inaccurate. You may also opt out of the sale or sharing of personal information — however, as of the date of this Policy, we do not sell personal information or share it for cross-context behavioral advertising and therefore do not provide a sale/sharing opt-out link. You can use an authorized agent. We will not discriminate against you for exercising any of these rights.

If you are a Texas resident. If the Texas Data Privacy and Security Act applies to our processing of your personal data, you may have rights to confirm whether we process your personal data, access your personal data, correct inaccuracies, delete personal data and obtain a portable copy of certain personal data. You may also have the right to opt out of processing for targeted advertising, the sale of personal data or certain profiling.

If we decline a request and applicable law provides a right to appeal, you may appeal our decision by contacting us using the same method identified below and stating that you are submitting a privacy appeal. We will respond to the appeal as required by applicable law. If your appeal is denied, we will provide any further information required by applicable law concerning how you may submit a complaint to the appropriate regulator.

How to exercise your rights. Submit a request through our ask-a-question page and tell us what you want. We will respond within 45 days. If a request is complicated we may take longer, and we will tell you before we do. We may need to confirm your identity before we act on a request. Where applicable law imposes a response deadline, we will respond within that deadline, including any legally permitted extension.

11. Children

This site is built for people in business doing their jobs. It is not knowingly directed at anyone under 18 and we do not knowingly collect information from children through the site. If you believe a child has sent us personal information, tell us and we will take appropriate steps to delete it where required by law.

12. Other people’s websites

Where we link out — to a client, a partner, a booking tool, a source we cited — or make third-party content or functionality available, such as scheduling or social-media content, that third party has its own privacy policy and we do not control it. This policy stops at our edge and does not govern information you provide to a third party. If a third-party service provides information back to us in connection with a service you request or a business relationship with us, our handling of the information we receive is governed by this Policy or, if applicable, the separate agreement governing that relationship.

13. Changes

We will change this page as our site, technology or privacy practices changes. The date at the top is the date this Policy was last updated. If a change is material, we will say so on the page rather than making you diff it. If we make a material change to how we collect, use or disclose personal information, we will provide any additional notice required by applicable law before the change becomes effective.
